1) Who we are
Ali Aesthetics & Wellness (“we,” “us,” “our”) is a Florida medical clinic and med spa offering hormone therapy (HRT), peptide therapy, IV infusions, vitamin injections, wellness services, and aesthetic procedures (e.g., neuromodulators, fillers, PRP/PRF, PDO threads, lasers, hair restoration, skin resurfacing, scar care).

2) Acceptance of These Terms
By accessing our website, booking or receiving services, communicating with us by phone/text/email, or participating in events or financing programs, you agree to these Terms. If you do not agree, do not use our site or services.
3) Not Medical Advice; Individual Results
Content on our website, social media, emails, texts, and printed materials is informational only and not a substitute for individualized medical advice. In-clinic decisions are made after a licensed provider reviews your history, exam, risks, and goals. Results vary and are not guaranteed. Off-label use may be discussed where clinically appropriate.
4) Eligibility & Patient Responsibilities
You must be 18+ (or accompanied by a legal guardian for eligible services).
You agree to provide complete and accurate medical history, medications, allergies, and to update us with any changes.
You must follow pre-/post-treatment instructions and immediately report adverse events.
Certain conditions/medications may contraindicate treatment; we may decline or modify treatment for your safety.
5) Scheduling, Late Arrivals, Cancellations & No-Shows
Booking: We use JaneApp for scheduling and reminders.
Late arrivals: >10 minutes late may reduce treatment time or require rescheduling; fees may apply.
Cancellations: Please cancel or reschedule ≥24–48 hours before your appointment. Late cancellations may incur a late fee or forfeit of deposit.
No-shows: No-showing may result in a no-show fee and deposit requirement for future bookings.
Deposits: Some services require a non-refundable reservation fee that is applied to the service if you attend.
6) Payments, Pricing & Refunds
We are a cash-based practice and do not bill insurance.
Accepted forms: JaneApp, Square POS, CashApp, Venmo, Zelle, cash; financing via Cherry and CareCredit (subject to third-party approval/terms).
Payment is due at time of service. Retail products and prepaid packages are due at purchase.
Prices may change without notice. Quotes provided during consults are estimates, not guarantees.
Refunds: Medical services, treatments, and opened medical products are non-refundable. We do not guarantee outcomes or provide refunds for dissatisfaction with results. At our discretion, we may offer adjustments or alternative treatments when clinically appropriate.
Chargebacks/Disputes: By receiving services, you agree not to dispute valid charges for rendered services/products.
7) Packages, Promotions, Gift Cards & Memberships
Packages & prepaid series: Non-transferable, non-refundable, and expire [insert timeframe] from purchase unless prohibited by law.
Promotions/discounts: Cannot be combined unless explicitly stated. Subject to change or end at any time.
Gift cards/certificates: Treated as cash; not redeemable for cash; lost/stolen cards may not be replaced; subject to state law.
Memberships: If offered, membership fees are billed per your plan; unused benefits do not roll over unless stated; cancellation per membership terms.
8) Photos, Testimonials & Educational Use
Clinical photos are typically required for charting and safety.
Marketing use: We will only use your images/testimonials for marketing with your written authorization. You can revoke future use in writing; already published materials may remain in circulation.
We may host trainings, shadowing, or educational events; you consent to incidental presence of licensed learners or staff unless you request otherwise.
9) Telehealth
If telehealth is offered, you agree to use the designated platform, confirm your location in Florida at the time of the visit (if required), verify identity, and ensure a private environment. Telehealth may have limitations compared to in-person care.
10) Communications Consent (Email/SMS)
By providing your phone or email, you consent to receive transactional messages (confirmations, reminders, instructions). Marketing messages are sent only with consent where required; you can opt out anytime (SMS: reply STOP). Message/data rates may apply.
11) Contraindications, Risks & Informed Consent
Every procedure carries risks (e.g., bruising, swelling, redness, infection, scarring, vascular occlusion, pigment change, burns, allergic reactions). You will receive and sign procedure-specific informed consent before treatment. Ask questions until you are comfortable proceeding.
12) Right to Refuse Service & Patient Conduct
We may refuse, discontinue, or reschedule services for safety, clinical appropriateness, policy violations, harassment, intoxication, or disruptive conduct.
13) Website Terms of Use
A) Intellectual Property
All site content (text, logos, graphics, photos, videos) is owned by us or our licensors and protected by IP laws. You may not copy, distribute, modify, or exploit content without prior written permission.
B) Acceptable Use
You agree not to misuse the site, attempt unauthorized access, introduce malware, scrape data, or infringe rights.
C) User Submissions/Reviews
If you post or send content (e.g., reviews), you grant us a non-exclusive license to display and reproduce it in connection with the site and our services, subject to our Privacy Policy and any required authorizations.
D) Third-Party Links & Tools
Our site may link to external sites (e.g., payment/financing, labs, social platforms). We are not responsible for third-party content or policies. Use at your own risk.
E) Accessibility
We aim to make our site accessible. Contact us if you encounter issues so we can assist or provide alternatives.
14) Disclaimers & Limitation of Liability
No warranties: The site and services are provided “as is” and “as available.” We disclaim warranties to the fullest extent permitted by law.
Limitation: To the maximum extent permitted by law, we and our owners, employees, contractors, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data arising from or related to the site or services.
Cap: Our total liability to you for any claim related to services is limited to the amount you paid for the specific service giving rise to the claim.
Medical emergencies: Call 911 or go to the nearest emergency room.
These provisions do not limit liability where prohibited by law.
15) Indemnification
You agree to indemnify and hold us harmless from claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site/services, violation of these Terms, or violation of law or third-party rights.
16) Privacy; HIPAA
Personal information is handled under our Privacy Policy. When HIPAA applies, our HIPAA Notice of Privacy Practices governs PHI. Please avoid sending PHI through unsecured channels (e.g., standard email or DMs).
17) Financing & Third-Party Services
If you apply for or use third-party services (e.g., Cherry, CareCredit, Square, CashApp, Venmo, Zelle, Quest Diagnostics, pharmacies, JaneApp), your information is processed under those providers’ terms and privacy policies. We are not responsible for third-party decisions or systems.
18) Gift Certificates & Coupons – Fine Print
Not redeemable for cash; no cash back.
Lost/stolen cards may not be replaced.
Coupons/credits cannot be combined unless stated and are valid only during the promotional period.
Service eligibility is subject to clinical evaluation.
19) Governing Law; Venue
These Terms are governed by the laws of the State of Florida, without regard to conflicts principles. Exclusive venue for any dispute is the state or federal courts located in Hillsborough County, Florida (unless arbitration applies).
20) Changes to Terms
We may update these Terms at any time. Changes take effect upon posting with the “Effective Date” above. Your continued use of the site or services after changes means you accept the updated Terms.
